1. Acceptance of Terms

By accessing or using darnizzle.com (the "Site") and our services, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the Site.

2. Services Overview

Darnizzle LLC (operating as "Darnizzle") offers:

• Professional music services: mixing and mastering, features, graphic design (including social media design), shout-outs.
• Physical merchandise (fulfilled via Shopify).
• Digital products and bundles (BandLab/FL Essentials).
• Community access and educational content through Rising Sounds (launching 2026).
• Darnizzle Rewards, our loyalty program, which has its own Rewards Terms.

3. Orders, Payment & Refunds

All prices are listed in USD and are charged at checkout via Stripe (services) or Shopify (merchandise and digital products). By placing an order, you authorize us to charge the payment method provided.

Digital products (kits, presets, and templates) are delivered immediately. If a file is missing, corrupted, will not download, or does not work as described, contact us within 30 days and we will refund you in full. That includes any case where a product requires a paid plan, edition, or feature on a third-party platform that we did not clearly disclose before purchase. Outside those situations we generally cannot refund a digital product once it has been downloaded, because it cannot be returned. If you are a consumer in the EU or UK, you keep your statutory 14-day right of withdrawal on digital purchases and we will honour it. This applies even if you have already downloaded the file. Custom service work is non-refundable once work has begun.

Digital products are not offered for sale to customers in the European Union, the European Economic Area or the United Kingdom. Orders identified as originating from these regions may be cancelled and refunded. Physical TENACITY apparel is also not shipped to these regions.

For physical merchandise (the TENACITY apparel line), report any defective, damaged, or misprinted item, or an item that is not what you ordered, within 14 days of delivery with a photo, and we will replace it or refund it at your choice and at no cost to you. Because apparel is made to order, we do not accept returns or exchanges for buyer's remorse or a wrong size, so please check the size chart on each product page before ordering. Approved refunds are issued to your original payment method, and there is no restocking fee.

4. Delivery, Shipping & Turnaround

Digital products are delivered to the email you provide at checkout. Service turnaround times are listed on each service page and are good-faith estimates, not guarantees. Physical merchandise is printed on demand and made to order: items typically ship within 2 to 7 business days plus carrier transit time, and estimated timeframes are shown at checkout. If we cannot ship within the estimated timeframe or within 30 days, we will notify you and give you the choice to keep waiting or cancel for a refund. You are responsible for keeping the checkout email accessible.

5. User Conduct

You agree not to misuse the Site, attempt to access non-public areas, interfere with other users, or upload content that infringes intellectual property rights or violates law.

6. Intellectual Property

All Site content (logos, text, graphics, audio) is owned by Darnizzle LLC or its licensors. Custom service deliverables become yours upon full payment, except for any third-party samples or stems identified at delivery. You retain ownership of files you submit for processing.

When you purchase a digital product (a drum kit, preset, template, or similar), we grant you a non-exclusive, royalty-free license to use it in your own musical works, including commercial releases. You may not resell, redistribute, share, or repackage the files themselves, whether in original or modified form, as a standalone product.

7. Disclaimers & Limitation of Liability

The Site and services are provided "as is" without warranties of any kind, express or implied. We do not warrant uninterrupted or error-free operation.

To the maximum extent permitted by law, Darnizzle LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or services. Our total liability for any claim is limited to the amount you paid us in the 90 days preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages, so some of the above limitations may not apply to you. Nothing in these Terms limits any consumer rights that cannot be waived under the law of your country of residence.

8. Governing Law

These Terms are governed by the laws of the State of New York, USA, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in New York. If you are a consumer in the EU or UK, you also keep the protection of any mandatory provisions of the law of your country of residence, and this clause does not deprive you of them.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes constitutes acceptance. The effective date at the top of this page reflects the most recent update.

10. Eligibility & Accounts

You must be at least 13 years old to use the Site, and at least 18 (or the age of majority where you live) to make a purchase, or have a parent or guardian's permission. If you create an account, you are responsible for keeping your login credentials secure and for activity under your account. We may suspend or close accounts used for fraud, abuse, or violations of these Terms.

11. Copyright Complaints

We respect intellectual property rights. If you believe content on the Site, or a file submitted through our services, infringes your copyright, email darnizzlecollective@outlook.com with the work at issue, its location on the Site, and your contact details, and we will review and respond promptly.
